Bail Granted to Car Dealer in Attempted Murder Case

The Delhi High Court has granted bail to a car dealer accused of attempted murder in a drive-by shooting case. The court’s decision was based on several factors, including the absence of grievous injuries to the victim, the lack of recovery of the weapon used in the alleged crime, and the prolonged incarceration of the accused without significant progress in the trial.

Justice emphasized that the right to a speedy trial is a fundamental right under Article 21 of the Constitution, and the accused’s prolonged detention without trial progress would be a violation of this right. The court also noted that a co-accused in the case had already been granted bail, and the allegations against both individuals were similar.

The court imposed strict conditions on the accused, including furnishing a bail bond of ₹15,000 with one surety, not tampering with evidence, regular attendance in court, and providing a functional mobile number to the Investigating Officer. The court’s decision highlights the importance of balancing the rights of the accused with the need for a fair and speedy trial.
